Drug Abuse Prevention (3): RA 9165

Below are provisions of the law, Republic Act 9165, requiring entrepreneurs to promote a drug free company.

Art. 3 Sec 36

“Officers and employees of public and private offices, whether domestic or overseas, shall be subject to undergo a random drug test as contained in the company’s work rules and regulations, which shall be borne by the employer, for purposes of reducing the risk in the workplace. Any officer or employee found positive for use of dangerous drugs shall be dealt with administratively which shall be ground for suspension or termination, subject to the provisions of Article 282 of the Labor Code and pertinent provisions of the Civil Service Law”.

Art. 5 Sec. 47

“It is deemed a policy of the State to promote drug-free workplaces using a tripartite approach. With the assistance of the Board, the Department of Labor and Employment (DOLE) shall develop, promote, and implement a national drug abuse prevention program in the workplace to be adopted by private companies with ten (10) or more employees. Such program shall include the mandatory drafting and adoption of company policies against drug use in the workplace and in close consultation and coordination with the DOLE, labor and employer organizations, human resource development managers and other such private sector organizations”.

As of this writing, the information campaign to all our business centers are done. Anytime soon, the mandatory drug testing will commence. Facilitating a symposium or training session isfun but needs ample preparation, specially if one is tasked to speak in front. Quick tips:

  1. Mastery of the subject matter.
  2. Power Point presentation– have a back up copy in a flash disk, just in case something very bad will happen to your original copy or your lap top.
  3. Facilities and equipment– ensure this was checked prior and the venue is convenient with working air con, pa system, multi media projector and lap top.
  4. As presentor, one should look smart and relax. Ladies may have to exert a little more effort as dress (styles and color) and platform shoes should match.
  5. Audience– know your audience so you can ask appropriate questions, use relevant examples and connect with them.

Drug Use in the Workforce
Current employment status was highly correlated with rates of illicit drug use in 2002. An estimated 17.4 percent of unemployed adults aged 18 or older were current illicit drug users compared with 8.2 percent of those employed full time and 10.5 percent of those employed part time. Of the 16.6 million illicit drug users aged 18 or older in 2002, 12.4 million (74.6 percent) were employed either full or part time. Most binge and heavy alcohol users were employed. Among the 51.1 million adult binge drinkers in 2002, 40.8 million (80 percent) were employed either full or part time. Similarly, 12 million (79 percent) of the 15.2 million adult heavy drinkers were employed.
Drug Use by Industry
In 2000, workers in the construction and mining industries reported the highest rates of past month heavy alcohol use (15.7 percent) and past month illicit drugs use (12.3 percent) while workers in professional services and in government had the lowest rates. This pattern is partially explained by the higher concentration of males in the construction and mining industries, who have reported higher rates. Workers in wholesale and retail industries also reported high rates of past month illicit drug use (10.8 percent) and past year dependence or abuse of alcohol (10.5 percent).
Drug Use Effects on Performance
A 2000 SAMHSA study revealed that workers who reported past month illicit drug use were more likely than those who did not report such use to say that: they had more than three employers in the past year (5.7 percent vs. 2.3 percent), they had missed work for more than two days in the past month due to illness or injury (11.6 percent vs. 6.5 percent), and they had skipped work more than two days in the past month (4.4 percent vs. 1.6 percent).
